ئێمە كۆمیتەی داکۆکی لە ماف و ئازادییەكانی خەڵکی کوردستان نامه‌یه‌كی كراوه ئاراسته‌ی ده‌سه‌ڵاته‌كانی یاسادانان و جیبه‌جێكردن و دادوه‌ری دەكەين، جگه له داوای ئازادكردنی چالاكوانانی مه‌ده‌نی و رۆژنامه‌نووسانی پارێزگای دهۆك، لێره‌وه به بۆنه‌ی خراپی رەوشی تەندروستی و ناشیاوی شوێنی بەندكردنی زیندانیانی بادینان داواكارییه‌كانی دیكه ده‌هێنینه‌وه یاد چونكه دۆخی دەستیگركراوەكان تاكو دێت بەرەو خراپی دەچێت و خواردنیان کەم و خراپە و کێشیان زۆر دابەزیوە، پێداویستی سەرەتیان پێ نادەن و تەنانەت کتێب، پێنوس و کاغەزیان لێ قەدەغەکردون.
دەستگیركراوەكانی بادینان لە لە شوباتی ئەمساڵدا لە ژینگه‌یه‌كی پڕ ترس و تۆقاندن دادگای كراون و زیندانی كراون ، له كاتێكدا ده‌ستووری هەمیشەیی عێراق له مادده‌كانی 37 و 39 و 42 و 46 زامنی ئازادییه‌كان، كاری رۆژنامه‌وانی، خۆپیشاندان، كردووه. به‌ڵام حكومه‌تی هه‌رێم و داموده‌زگا ئه‌منییه‌كانی بە پێچەوانەی دەستور و یاسا مامەڵە لەگەڵ رۆژنامەنووس و چالاكوانان و هاونیشتمانیانی هەرێمی كوردستان دەكات.
دواین راپۆرتی وەزارەتی دەرەوەی ئەمریكا لەبارەی رەوشی مافی مرۆڤ كە ئاماژەی بەوەكردووە زیندانی هەولێر وەها دروستکراوە کە جێی 900 گیراوی تیادا ببێتەوە بەڵام 1957 گیراوی تیادایە، كە 3 گیراو لەو زیندانەدا بەهۆی نەخۆشییەوە مردوون بەبێ ئەوەی چارەسەرییەکی ئەوتۆی تەندروستی بۆ نەخۆشییەکانیان بکرێت راستی ناوەرۆكی راگەیانراوەكەمان دەسەلمێنێت
بۆیه ئێمه داوا ده‌كه‌ین:
1 – كۆتایی بەبێ بەشکردن لە مافی بینینی پارێزەرەكانیان بهێنرێت ، کە بە پێ (اصول محاكمات جزائیە)ی دەبێت پارێزەرەکان لەگەڵیان بن و ئاگاداری دواین گۆرانكارییەكان بن.
2 – بارودۆخی دادگایی تێهەڵچونەوە کۆنترۆڵی حیزب بەسەر دەسەڵاتی دادوەری رەتدەكەینەوە و داوا لە دادوەرانی دادگای تێهەڵچوونەوە دەكەین سەربەخۆیانە بریار بدەن و لەبەرانبەر ئامانجێكی سیاسی بڕیار نادەن.
3 – ناوەڕۆکی راپۆرتی لیژنەی مافی مرۆڤ لە پەرلەمانی كوردستان دوای دیداری زیندانیان بۆ رای گشتی بڵاو بكرێتەوە.
٤-زیندانیکراوەکان مافی پەیوەندی و دیداری کەسو کاریان هەبێت.
٥- ڕەوشی تەندروستی و شۆێنی مانەوەیان لەبەرچاوبگیرێت و بەپێی ئەو هەواڵانەی بەدەستمان گەیشتوە. تەندروستی هەندێکیان خراپە بەهۆی پیسی و قەرەباڵغی ژووری زیندانەکان تەنانەت هەندێکیان تووشی نەخۆشی پێست بوونە.

An Open Letter from Rights and Freedoms Advocacy Committee to:

• All Non-Governmental Organizations in Iraq and the Kurdistan Region

It is with great sadness, despair, and disappointment that we are writing to you once again regarding the health and wellbeing of the five prisoners from the Duhok/Badinan region locked up on trumped-up charges. We have learnt through their families that the cruelty, shame, and absolute immorality of the authority knows no bound; the prison conditions are extremely poor including food shortages, malnutrition, gross overcrowding, physical and mental abuse, inadequate sanitary conditions and medical care, limited family and outside contact, lack of access to education and sports activities. Above all, the deadly combination of the congested prison cells and the rapid spread of the Covid-19 pandemic is mounting an immediate danger on their lives and the life of many other inmates.
The Duhok activists arrest and subsequent trial in February failed every characteristic of the Right to a Fair Trial even though the Iraqi Constitution guarantees the right to freedom of expression, freedom of association, journalism work and the right to demonstrations through Article 37, 39, 42 and 46. Unfortunately, Kurdistan Regional Government and its security apparatus have failed to follow the legal code and uphold the constitution in their treatment with the general public, journalists and activists.
The US department of state 2020 Country Reports on Human Rights Practices refers to a report by IHRCKR that stated, Erbil Correctional Centre, built to house 900 detainees, held 1,957 inmates. It further reports that three inmates with the chronic disease died without getting proper medical treatment due to overcrowding of detention centres. This report reiterates the content of this letter and highlights the dire conditions of the prisons in the Kurdistan Region.
Therefore, we urge:
1. The Kurdish Regional Government to take immediate actions to improve the prison conditions and take appropriate steps towards controlling the Covid-19 pandemic in the prisons.
2. For the reports of the Commission for Human Rights of the Parliament to be published following their visits to the prisons.
3. To put an end to denying Duhok prisoners’ access to their solicitors as they are entitled to maintain contact with their legal representatives according to the Iraqi Penal Code.
4. While we condemn the shadow of the party-politic over the judiciary in Kurdistan Region, we urge the Appellate court judges to rule independently and avoid being influenced by political motives.
5. The Kurdish Regional Government to ensure prisoners are maintaining family and outside contact as it is a crucial pillar of their health and wellbeing.
